Please note that (i) the domain name/ website www.careerlauncher.com and/or (ii) any other software application for use on wireless computing devices such as smartphones and tablets and also for use on desktop or laptop computers ((i) and (ii) hereinafter collectively referred to the “Electronic Media Platform”) is developed, owned, controlled, managed and/or operated by CL Educate Ltd, a private limited company, incorporated in accordance with the laws of India, either itself and/or through its group companies, subsidiaries, affiliates, and/or associate companies (hereinafter collectively referred to as the (“Company”). The Company, through the Electronic Media Platform, provides certain products, services, content, materials and information to the users/ visitors (whether registered or otherwise) of the Electronic Media Platform in the field of education sector and knowledge management.

Amongst other, the Electronic Media Platform provides users access to a wide scope of content, material, resources and information about educational institutes, books, professional development, training programmes etc. (“Information Services”), the use and access of which is governed by the terms hereof (“TERMS”). Please read the following TERMS carefully before using the Electronic Media Platform. Any access to and use of the Electronic Media Platform and Information Services will be strictly governed by the TERMS and is based on the condition that the you/ user of the Electronic Media Platform agree to the TERMS. That certain information, content, material contained in and posted in the electronic media platform and the information services are based on the resources and information of third parties, including, interalia, information/material/resources available in public domain, available from governmental instrumentalities, those available through subscription based websites/electronic platforms etc. While the company endeavours and attempts to verify and confirm the correctness, accuracy and of the resources and information of such third parties prior to its inclusion on the electronic media platform and provision of the information services, however, the company shall not in any way be liable and responsible for the review, endorsement, recommendation, verification, evaluation, warranty or guarantee in respect of information, content, material contained in and posted in the electronic media platform and the information services that are based on the resources and information of such third parties. Thus, the company, its affiliates, or any of the foregoing's officers, directors, shareholders, employees, sub-contractors, representatives, agents etc. Disclaims all liability, warranties and responsibilities in respect of the provision of the information services, and access provided to content, material, information and resources posted or incorporated in the electronic media platform and the use, reliance and procurement thereof by the users/visitors/third party information providers.

All information and content provided on the electronic media platform is intended to be general in nature and the user should not rely solely on it or in connection with making any decision. The visitor/user understands that except for the information, products and services clearly identified as being supplied by company, the company does not operate, control or endorse any information, products, or services appearing on the electronic media platform in any way. So far as permitted by law, the company expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the non-infringement of intellectual property rights, completeness, compatibility, reliability, accuracy, security, satisfactory quality, merchantability or fitness for or any particular purpose.

The company makes no warranty that (i) the information services will meet the requirements of the user; (ii) the information services will be uninterrupted, timely, secure, or error-free; (iii) the results obtained/ reliance placed from the use of the information service will be accurate, reliable, complete or current; (iv) the quality, credibility and reliability of any products, services, application, information, or other material purchased or obtained by the user through the electronic media platform and the information services, will meet the expectations of the user/vissitor; and (v) any errors in the information service will be corrected. Any material downloaded or otherwise obtained through the use of the information services and electronic media platform is done at sole risk of the user and that the user will be solely responsible for any damage. Loss, costs etc. That results from the same.

No advice, content, material, products, resources, service or information, obtained by you from the company/electronic media platform, or through or from the company’s infomation services, shall create any warranty not expressly stated in the terms.

The company is not responsible for incorrect or inaccurate entry of information, content, material, resources, human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, failures of any telephone network, computer equipment, software of any combination thereof, or inability to access the electronic media platform.

The company does not guarantee that the electronic media platform is free from viruses and the user shall, for its own protection, take necessary steps to ensure appropriate security measures and may utilize a virus scanner before downloading any information, software or documentation.

Any links to other websites/portals on the electronic media platform are only for convenience and the company shall not responsible for the contents and reliability of such linked websites/applications and portals. Further, presence of any links or portals on the electronic media platform should not be assumed as endorsement of any kind by the company.

In no event shall the company or its content providers be liable for any damages whatsoever, whether direct, indirect, special, consequential and/or incidental, including without limitation, damages arising from loss of data or information, loss of profits, business interruption, or arising from the access and/or use or inability to access and/or use content and/or any service available on the electronic media platform

The company expressly disclaims all representations and warranties related to information, content, material and/or resources posted, provided, contained in or transmitted through the electronic media platform. If a user decides to rely on the information, content, material and/or resources posted, provided, contained in or transmitted througgh the electronic media platform, the user/visitor must exercise a high level of care, caution and scrutiny. The user/visitor shall not have any claim or demand against the company, its affiliates, and/or any of the foregoing's officers, directors, shareholders, employees, sub-contractors and/or agents with respect to any information, content, material and/or resources posted, provided, contained in or transmitted through the electronic media platform which the user receives, uses and/or relies on.

The use and acess of the electronic media platform and the provision/availing of information services, is done at your sole risk, and hence you agree that the company shall be in no event liable for any injury, losses, claim, damage or any special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arises out of or is any way connected with the aforesaid. The user shall not have any plea, claim or demand against the company, its affiliates, and their respective officers, directors, shareholders, employees, sub-contractors and agents etc. In use and acess of the electronic media platform and the provision/availing of information services.

To the extent permitted by applicable law, neither the company nor any of our officers, directors, employees, representatives, subsidiaries, associate companies, group companies, affiliates, partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the electronic media platform, information services, and its information, contents, materials and/or resources shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy, veracity, and incompleteness relating to the information, contents, materials and/or resources as made available on our electronic media platform and informeetion services, (iii) the information services rendered, provided and/or avialed by any user, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use, access or delay of our electronic media platform and information services, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the third parties from whom the resources and information is taken/relied upon for provision and availing of information services or the information, content, material and/or resources posted, provided, contained in or transmitted through the electronic media platform.

The aforesaid, disclaimers, waivers, releases, limitations and exclusions will apply regardless of whether the cause of action or the liability arises in laws, contract, tort or otherwise.
